1. Formation Of Contract DIY – Supply only
A legally binding contract between you and Brisbane shutters will be established once we have received full payment for the goods from you. Please note that we can only process your order once the full payment has been made. We accept online payments through major credit cards, debit cards, and other specified payment methods. To ensure the security of your payment card details, they will be encrypted to minimise the risk of unauthorised access or disclosure. Please provide payment authorisation at the time of placing your order. You will be charged for the items at the point of order. Our liability to you in connection with any order will not exceed the total price charged for the relevant items.
2. Price
The price displayed at the checkout and on your confirmation email is the price you will pay, and it includes the Goods and Services Tax (GST). All prices on our online store are in Australian Dollars (AUD).
3. Order Cancellation or Change
3.1 Cancellation
Before Manufacturing: Due to the customised nature of our products, we are unable to accept cancellations once your order has been accepted. However, we strive to provide a positive experience for our customers, and if you change your mind before production begins, please contact us immediately. In some cases, we may be able to halt the production process and provide a refund for the amount paid, excluding any costs incurred in processing and manufacturing your order. Please note that this option is not guaranteed. For ready-made products that have not been dispatched for collection, we can offer a refund for the amount paid, excluding any processing and preparation costs.
3.2 Refund Process:
If your order is eligible for cancellation and refund, the refunded amount will be transferred back to your account. Please note that it may take a few days for the refunded funds to appear in your account due to interbank transfer delays. For order cancellations prior to production, our payment processors’ merchant fees (excluding Bank Transfer) will be deducted from the refund amount, as these fees are non-refundable to us. The refundable amount varies between payment methods, ranging from 2% to 7%.
3.3 Cancellation by Us:
We reserve the right to cancel your order under certain circumstances, including insufficient stock availability to fulfil your order, or a typographical or pricing error in the product information. If we cancel your order, we will notify you by email and refund any amount deducted from your credit card or Direct Debit as soon as possible, within 30 days of your order. We are not obliged to offer additional compensation for any disappointment caused by the cancellation.
4. Stock Shortages
We reserve the right to cancel your order if we have insufficient stock to fulfil the goods ordered, if the goods have been discontinued without our knowledge, or if a pricing or typing error has occurred due to a system failure. If we are unable to supply a particular item due to unforeseen circumstances beyond our reasonable control, we will notify you promptly. Unfortunately, no discounts or compensation can be offered in such circumstances.
5. Product Descriptions and Measurements
5.1 Accuracy of Product Representations
We strive to provide accurate representations of our products through photographs and digital production displayed on our website. However, please be aware that variations in computer monitors, such as different types, styles, and settings, may cause differences in shading and colour perception. To ensure your satisfaction, we strongly advise you to check the colours indicated and the description at your local Bunnings stores, as our colours refer to Dulux Australian colour charts and Colorbond colours. Custom colour, naming colour and the code for that colour is necessary and important. This is your responsibility to make sure the colour is correct. Being a non-standard colour will add on an additional 2-3 weeks for delivery. Additionally, variations in the paint process, whether it’s two-pack or powder coating, can result in slight colour variations and sheen differences. We recommend reviewing the colour and quality before placing your order. While we make every effort to ensure that the goods sold and delivered match any provided samples or descriptions, minor variations, changes in colour or pattern, shall not entitle you to reject the goods or claim compensation for such variations. Some product photography may show slight variations in models and appearance, and they are used for illustrative purposes only. Please note that colour can also vary between painted supplies to the manufacturer due to production in different batches. To avoid potential issues, we encourage customers to order their products at the same time. The product information and pictures contained on the site are provided for illustrative purposes only and may not exactly reflect the actual product.
5.2 Measurements
As some products are custom-made, we are unable to offer returns or refunds if you have provided incorrect measurements. It is crucial that you ensure the accuracy of the product you desire and the size you require. We recommend taking advantage of our free Zoom chat online before placing an order. Brisbane shutters cannot be held responsible if you are dissatisfied with the colour or general quality of the product. We strongly urge you to double-check your order and measurements to ensure their correctness. It is your responsibility to follow our measurement instructions, which can be found on the “How to Measure” page. We provide these instructions at multiple points along the product page to minimise any potential oversight. We cannot be held liable for ill-fitting products or products ordered incorrectly due to failure to follow the proper measurement instructions. By using our website instructions, you agree to assume any associated risks, as interpretations may vary.
6. General Information
6.1 Magnets on Internal Shutters
The magnets are there to keep the shutters from opening in normal circumstances. They are strong enough to cater for normal breezes; however, in high winds, they might open from the force. This can be rectified at an additional cost by adding additional magnets to the shutters (cost upon application per Shutter). We suggest that during high wind times, the window needs to be closed or the shutters may blow open (we take no responsibility for the shutter being blown open and causing damage to objects or injuries to people). Common sense prevails: if it is windy, close the windows.
6.2 Cosmetic
Any marks which can be visibly seen by the naked eye closer than 1.8m away from the shutter will not be deemed as a cosmetic defect. Any marks visible from 1.8m and further back will be a warranty. This needs to be claimed and mentioned within 2 hours of the product being delivered for any claim.
6.3 Procedure for Filing a Warranty Claim
An email will only be accepted with a description of the issue and a small video from a smartphone of the issue to be sent to support@readymadeshutters.au. From there, the team will determine whether the fault of the product is under warranty. If accepted under a warranty claim.
6.4 Delivery of Your Goods
Please refer to our complete Delivery Policy, which can be found on the question and answer drop-down. By making a purchase, you agree to comply with all terms and conditions outlined in that policy. If you select to leave the parcel without a signature (no one home), the liability of the delivery becomes the homeowner’s, and missing parcels due to theft or damage are now the full responsibility of the homeowner.
6.5 Defective Goods
Please review our comprehensive Warranty policy, available on the relevant page. By making a purchase, you agree to adhere to all terms and conditions specified in the policy.
6.6 Representations
No statement, description, or recommendation found in any catalogue, price list, advertisement, communication, or on the pages of our online store, or provided by any employee or agent of Brisbane shutters, shall be interpreted to enlarge, vary, or override any of these terms and conditions.
7. Events Beyond Our Control
We cannot be held liable for any failure to deliver goods, delays in delivery, changes in specified delivery dates, or any damage or defect to delivered goods caused by events or circumstances beyond our reasonable control. Such events or circumstances may include, but are not limited to, third-party defaults, strikes, lockouts, industrial disputes, system or network access breakdowns, floods, fires, explosions, accidents, theft, or shipping-related issues.
8. Invalidity
If any part of these terms and conditions is deemed unenforceable, including provisions in which we exclude liability, the enforceability of the remaining conditions will not be affected.
9. Privacy
We prioritise the protection of your personal information and do not engage in selling, trading, or renting it to others. However, we may utilise the services of other companies and individuals to assist us in tasks such as company and product research, package delivery, email and mail communication, and payment processing. These service providers will have access to the necessary personal information to perform their designated tasks, but we will not authorise them to use your information for any other purposes. By using our site, you agree to accept the use of cookie session storage, which is employed to retain the contents of your shopping cart.
10. Consumer Guarantee
In accordance with the Consumer Guarantee, if any part of your order is missing or incomplete, we will promptly replace it. A refund will only be issued if the item cannot be replaced or repaired.
11. Liability
Brisbane shutters cannot be held responsible for any charges related to third-party installation, including installation fees or call-out fees incurred by your nominated installers. Additionally, any damages resulting from the installation of our products are the responsibility of the customer. It is essential to follow proper installation guidelines, including using appropriate advice and anchors for different wall types.
